KCRC is a regular reader of my journal. Not only is he an asset to the rave and House Eternal, but he is also someone I enjoyed hearing from about current affairs. He is intelligent and always has something to add to my limited knowledge in some areas.
I am glad he pointed out the following to me. I did not want anyone reading my journal and getting the wrong impression of what actually happened in the case of the young man who went to jail for consensual sex with a girl around his age.
Here is what KCRC sent me. I would comment, but his words are enough to convey what I would say. His is also nicer and more calm.
From KCRC:
You've got most of it right. Except the circumstances of how the "Sexual Assault" occured. The girl in question did not exhibit very good moral decision making. SHe thought it would be fun to go around the room and give BJs to all of the football players. One of the guys taped the event on a camcorder an part of it was used as evidence in the trial. The rest of the guys were either closer in age and thus not subject to the law that was invoked, or took a plea bargin.
Thank you KCRC. Please free feel to let me know when I got the facts a little wrong. The same invitation is extended to anyone reading my journal.
ATLANTA, Georgia (CNN) -- Genarlow Wilson was released from prison Friday, after spending more than two years behind bars for a teen sex conviction.
At times I dealt with adversity ... my family and myself, we finally get to deal with happiness now," Wilson said, with his mother and sister at his side.
The Georgia Supreme Court earlier Friday ordered that he be released, ruling 4-3 that his sentence was cruel and unusual punishment.
Wilson, 21, was convicted in 2005 of having oral sex with a consenting 15-year-old girl when he was 17.
Wilson said he first heard about the possibility he'd be freed Friday when someone told him word was out on the radio.
"I'd seen it coming, but I didn't exactly know when," he said. "I'd just stopped trying to figure the courts out and stopped trying to put a date on it."
Wilson said he was looking forward to spending time with his family and plans to enroll in college to study sociology.
"You will not be disappointed," he told his supporters. "I plan on succeeding in life."
Wilson also said he doesn't regret rejecting a plea offer that could have freed him from prison months ago -- but would have required him to register as a sex offender.
"I'm glad I stayed down for my cause," he said. "I accepted the situation that I got myself into, but I never accepted that label."
Wilson's attorney, B.J. Bernstein, said earlier Friday she was working to gain his quick release.
She said Wilson's mother, Juannessa Bennett, was "overjoyed" at the court's decision.
A spokesman for Georgia Attorney General Thurbert E. Baker said there will be no further appeals.
Friday's decision came after a protracted legal battle that has galvanized international attention and drawn the involvement of civil rights leaders. Partly as a result of Wilson's conviction, state legislators changed the law to make such consensual conduct between minors a misdemeanor, rather than a felony.
"The release of Genarlow Wilson by the Georgia Supreme Court is a significant victory in redressing the reckless and biased behavior of the criminal justice system that now operates in many states across the union," the Rev. Al Sharpton said.
"The bad news is that his young life was so unfairly interrupted with time that no state court can recover for him," Sharpton added. "This is why the Justice Department and federal government must review state courts that willfully and almost without pause violate the civil rights of people, particularly young black men around this country."
Wilson was an honor student, a football star and his high school's homecoming king before his conviction.
At the time of Wilson's conviction, Georgia law made the crime punishable by 10 years in prison. Changes in the law made such conduct "punishable by no more than a year in prison and no sex offender registration," the Georgia high court noted.
But those changes were not made retroactive, so they did not apply to Wilson.
The high court upheld the decision of a Monroe County judge. In a 48-page opinion, the court said the "severe" punishment Wilson received and his mandated sex offender registration make "no measurable contribution to acceptable goals of punishment."
The case revolves around a 2003 New Year's Eve party outside Atlanta when Wilson engaged in the sex act with the girl.
Under the now-changed Georgia law, Wilson was convicted of felony aggravated child molestation. He was acquitted on a second charge of raping a 17-year-old girl -- who prosecutors maintained was too intoxicated at the party to consent.
The 10-year sentence was mandatory under the law.
In the decision, Chief Justice Leah Ward Sears wrote that changes in the law "represent a seismic shift in the legislature's view of the gravity of oral sex between two willing teenage participants."
"Although society has a significant interest in protecting children from premature sexual activity, we must acknowledge that Wilson's crime does not rise to the level of culpability of adults who prey on children," the court's majority found.
"For the law to punish Wilson as it would an adult, with the extraordinarily harsh punishment of 10 years in prison without the possibility of probation or parole, appears to be grossly disproportionate to his crime," the majority opinion concluded.
The dissent noted that the Georgia Legislature had made clear that the changes in the law were not to be applied retroactively.
Writing for the dissenting justices, Justice George Carley said, "The General Assembly made the express decision that he cannot benefit from the subsequent legislative determination to reduce the sentence for commission of that crime from felony to misdemeanor status."
The majority countered that it was not applying the 2006 amendment retroactively, but instead factoring that "into its determination that Wilson's punishment is cruel and unusual," the court said in a news release.
The court said this kind of decision is unusual: "The majority opinion points out that this court rarely overturns a sentence on cruel and unusual grounds. But twice before, it did so following a legislative change."
The Monroe County Superior Court judge also ruled that Wilson's punishment was cruel and unusual and voided it on constitutional grounds.
The judge reduced the sentence to one year and said Wilson should not be put on Georgia's sex offender registry, as the old law required.
Wilson's jubilant attorneys had hoped that ruling would free him from state prison. But shortly after it was handed down, Georgia's attorney general announced he would appeal that decision, a move that kept Wilson behind bars.
he Georgia high court said unanimously that the decision to deny Wilson bail was correct.

Wilson's plight drew pleas for his release, including from former President Carter, himself an ex-Georgia governor, and even some jurors who convicted him.
Legislation that would make the change in Georgia's child molestation law retroactive to free Wilson failed to win approval earlier this year.
)))))))))))))))))))))))))))))))))))))))))))))))))))))))))))))))))
I will be the first person to want to beat the holy hell out of any sex offender. I have received two cards at my current address since 2006 about sexual predators in my neighborhood. I made sure I looked at the photos long and hard. I wanted to make sure I knew what those two fellows looked like and could avoid them myself.
I do not think this is a black and white issue either. Yes, the defendant is an African- American male. So, is the original district attorney in the case. This is more of a common sense issue. The young kids in this case may have been having sex sooner than some in this country would have liked, but it was not like he was messing around with a thirteen or fourteen year old girl. That would have made me want him to stay behind bars. This boy went to a party, hooked up with a young girl around his age, and then spent two years in jail. I know the law that sent him there was put in place to protect children, but why waste taxpayer money on this case? This was a excellent student who was an athlete. They tried to make him accept a plea deal , if he registered as a sex offender. Then, his whole life would have be ruined. Someone not knowing the details of his case would think he violated a ten or eleven year old girl.
I hope this young man proves those who fought so hard for him that they were in correct in wanting to see him get a second chance. Hearing that he got himself in another stituation involving sex would make many think their efforts were wasted. My wish is that he goes on to have a good life.
I decided to rate a few whelps this afternoon. I ran across the following words on a profile:
Just looking for a fuck buddy with no strings attached and someone who can be completely discreet.
The user name is unimportant. The thing that gets me is this person has confused the rave with a dating site. Yes, people have hooked up on the rave with varying degrees of sucess. However, that is not the main purpose of this site to my understanding. If I am wrong , will someone please correct me?
Yesterday, I had a busy day at work. Wednesday is usually busy , because it is the day most of the new product comes in. I had to price and stock plus wait on customers. The children got out of school at 1 pm , so I had a rush about two hours early yesterday.
Then, the chore of laundry. I was going to do it the night before, but sleep overtook me. I was exhausted and so was my roommate. I remember eating something my roommate bought from Taco Bell, but I was so sleepy I do not think I enjoyed it as much as I normally would. I remember this radio playing at the laundry mat. At one point, they were playing " Let It Be" by the Beatles. I was singing Go to Sleep instead of Let It Be. You see how sleepy I was.
Tonight is going to be an early night unless I am not worn out after working today. My roommate is coming home and heading straight for bed. She already said as much.
Many people on the rave have busy outside lives. I just worked eleven days in a row. I have a 12 year old son and friends in real life that need me. I have no problem rating the database. I try to keep up with it. I just read a journal that stated those who use stamps are stupid and he is wondering how they operate a computer. Okay, dude you are entitled to your opinion. I may not agree with what you have written, but I will fight to the death for your right to write it. I just think that if something as simple as a person stamping a database entry gets you to call them stupid, then I am afraid that neither John Nash or Albert Einstein would rate as intelligent in your book.
I use stamps because it helps me. Not to offend the person who added the database entry or their friends on the rave. I do not say anything to those who rate me low because I stamped their profile. That is their feeling, their choice and has nothing whatsoever to do with me as a human being or my intelligence. The same goes for the stamping of a database item.
Before you call someone stupid, please get to know them. Also, if you are so surefire intelligent then I have some world problems that affect many people that I am begging you to solve in a humane, fair way to all.
1. Could you please stop Israel and Palestine from fighting? I know it is a centuries old issue, but since you see the folly of using a stamp to rate database entries God knows you can do this.
2 Could you figure out a way to stop people from abusing their children? I know one as wise as you must have an answer to this problem.
3 Is there anything you can do about poverty? I know you are above average in your intelligence. You again see how reckless it is to stamp a database entry. I am sure that LBJ when he was president of the United States could have used your help on the war on poverty.
This may not ever be seen by the person who wrote the journal entry. However, if this fits another person on the rave and they read my journal , so be it.
PITTSBURGH -- Rescue crews freed a woman trapped under a sport utility vehicle in Brookline late Monday morning.
Police said the woman, whose name has not been released, feared her husband was cheating on her. They said she went to spy on him by crawling under an SUV outside her husband’s alleged girlfriend’s house in the 1300 block of Oakridge Street.
She apparently fell asleep under the vehicle and became trapped after someone let the air out of the tires.
The couple has been married for 26 years. The woman was taken into custody to undergo a mental health evaluation.
Police are trying to determine who let the air out of the tires. So far, no charges have been filed.
&&&&&&&&&&&&&&&&&&&&&&&&&&&&&&&&&&&&&
I just do not see how a woman spying on a suspected cheat of a husband falls asleep. Maybe she should have hired a private investigator to get pictures or video of him and his girlfriend.
We have a person on here with a new profile that thinks it is a good idea to use the word niggerhater01 as his user name. Why would he do that? Or she? Just to offend people. Anyone with any ounce of sense in America knows that is an offensive term that has been and is still used to downgrade African- Americans. I rated this profile a one which is something I rarely do.
The user claims to be a redneck in his profile. I have no problem with most rednecks. Being a redneck does not make one a racist. I have enjoyed the comedy of Jeff Foxworthy who made himself quite famous and rich with his You Might Be a Redneck jokes. Could a redneck be racist? Yes , it is quite possible. So, could someone living in upstate New York. Geographical location does not make one immune to being racist.
IF you have been reading my journal, then you know that at one of my jobs I had a male co-worker that a lot of the females wanted to be with and that it caused problems sometimes. Well, I did find him attractive , but I did not need the problems that came from other co-workers about him and I knew his sister who worked on the job had an issue with him dating outside of his race. He is African- American. Some ( notice I said some. I did not say all. Anyone using all to refer to a whole group of people is either stupid, bigoted or both. Example : All Mexicans are illegal immigrants in this country trying to take jobs away from Ameicans. Well, unless someone has met everyone of Mexican- American hertiage in this country and checked their immigration status or citzenship papers, there is no way they are stating something they know for sure. Point this out to one of those retarded, bigots making that statement and that should shut them up. ) , I repeat some African- American women have a problem with African-American males dating outside their race, especially if the person they are dating could be classified as white by looking at their skin tone. His sister struck me as someone with that problem. I think I may have hit the nail on the head with that one.
Anyway, said co-worker hooks up with a female on the job that could be classified as white. This is after he has had a problem having sexual relations with yet another coworker. No, this guy is not in his early twenties. He is fifty-five years old and should know not to get entangled in romantic or sexual messes. He was surely old enough to learn his lesson the first time about screwing co-workers, especially from this particular job.
He gets the girl pregnant. Now, he knew this girl has had four miscarriages and eventually wanted a child of her own. No, she was not getting knocked-up to trap this fellow or to get him to marry her. It was unplanned. Yes, she plans on keeping the baby and will do it on her own if she has to. He stated he should be thinking about retirement and not supporting a child, when he found out she was pregnant. He also stated marriage was not in his future. This guy lives with his sister. Did he really think someone was thinking about dollar signs when they got with him? I hope not.
I have been friends with this guy and still am in my book. I just do not know where his head is at. Apparently, his brains do not function as well as his third leg. I do not like the attitude he has taken about this and I do not like the fact that his sister is being funny at times with the girl who is pregnant. She did not get that way by herself. It does take two to tango. The child is not even on the planet yet and I can see that one side of its family may never fully accept it. That is sad. You would think that in 2007, that we could behave better when it came to race relations and treat each other like human beings. We are all members of the same race- the human race. Unless someone involved in this is from another planet, we all are human and native to the earth. After Little Rock, Martin, Malcolm, Caesar Chavez, the Birmingham Bombing, we still cannot get our act together when it comes to race and treating all people with respect. We hold these truths to be self-evident that all men are created equal is the first sentence of the Declaration of Independence. Unless we just want to say the Declaration of Independence is made up of hollow words on a piece of old paper, we have to treat everyone regardless of their ethnic hertiage with respect. Yes, I know that the Declaration of Independence historically did not cover everyone at the time it was written. Women were totally left out of the equation. Thomas Jefferson did something he might not have intended to when he wrote those famous words. Let's revisit them. We hold these truths to be self-evident that all men are created equal. That was written before the womens rights movement. Men meant in those days both genders. It later was used by those of African hertiage to demand their rights under the law. Bet Jefferson did not know what floodgates he was opening with those words.
And it does not matter to me one iota what race the bigot is either. An African- American hating white people because of their skin color is just as much a bigot as someone belonging to a hate group that is against African-Americans. And please I hope no-one gives me the old tired excuse that I hate white people because of what they have done to me. Malcolm X once called white people devils because he was a member of the Nation of Islam and had been mistreated by whites his whole life. Very few African-Americans experienced what he did. IF they did, you can bet they are not in the twenty to thirty year old crowd, unless they have been the victim of a hate crime. Malcolm went to Mecca on a pilgimage and saw light skinned people who treated him with respect and like a brother. He then realized that not everyone of a different race was bad and out to get him. Brings me back to those all statements. They are not correct and cause faulty thinking, don't they?
WASHINGTON (CNN) -- Muslim and Jewish groups on Monday sharply criticized Sen. John McCain's comments that he would prefer a Christian president to lead the United States.
The Arizona Republican's remarks came in an interview with Beliefnet, a Web site that covers religious issues and affairs.
"I just have to say in all candor that since this nation was founded primarily on Christian principles, personally, I prefer someone who has a grounding in my faith," the GOP presidential hopeful told the Web site in an interview published Saturday.
McCain also said he agreed with a recent poll that 55 percent of Americans believe the U.S. Constitution establishes a Christian nation. "I would probably have to say yes, that the Constitution established the United States of America as a Christian nation," he said.
On Sunday night, McCain sought to clarify his remarks while campaigning in Hollis, New Hampshire. "What I do mean to say is the United States of America was founded on the values of Judeo-Christian values, which were translated by our founding fathers which is basically the rights of human dignity and human rights," he said.
"I believe that anyone can be president of the United States of any faith," McCain said, saying he was angry his remarks were misinterpreted but "there's nothing I can do about it."
Ibrahim Hooper, spokesman for the Council on American-Islamic Relations, said McCain's comments failed to recognize that Christianity is not the only faith with beliefs that support the concept of human rights.
"Sorry, Islam and other faiths have their basis in human dignity," Hooper said.
McCain's remarks also "go against the traditions of American pluralism and religious pluralism and inclusion," Hooper said.
Hooper's organization, a Washington-based Islamic civil rights and advocacy group, said it's trying to organize a group of Muslim leaders to meet with McCain.
The National Jewish Democratic Council, an advocacy group representing Jewish Democrats, also called on the Republican Party to denounce the remarks formally.
"Former maverick John McCain's statements were repugnant," the group's executive director, Ira N. Forman, said in a statement. "It's been sad watching him transform from political maverick to religious right mouthpiece."
Forman added, "Someone running for president ought to understand the Constitution a little better. Nowhere does it say the United States is a 'Christian' nation. How can we trust someone to uphold the Constitution who doesn't even know what is in it?"
McCain's communication director, Jill Hazelbaker, issued a statement Sunday defending her candidate's comments: "Read in context, his interview with Beliefnet makes clear that people of all faiths are entitled to all the rights protected by the Constitution, including the right to practice their religion freely.
In the interview he also observed that the values protected by the Constitution, by which he meant values such as respect for human life and dignity, are rooted in the Judeo-Christian tradition. That is all he intended to say to the question, America is a Christian nation, and it is hardly a controversial claim."
*****************************************
Well, I think it is safe to say that I am not voting for John Mc Cain. Nowhere does the Constitution say anything about the United States being a Christian nation. Also, I do not think Christians have a monopoly when it comes to respecting human rights. Does Mc Cain remember a little thing called the Crusades? I do not find it very humane to go kill people because they have a different religion.
The Bill of Rights ( which is part of the US Constitution.- I highly recommend Mc Cain gets a copy of that document and read it. ) states we have freedom of religion. Perhaps, Mc Cain interpets that to mean that as long as you are a Christian you can practice any Christian faith you want. If that is the case, I am thankful he does not serve as a justice on the Supreme Court.
It was mentioned on the Stituation Room a few moments ago that Mc Cain may be trying to get the vote of the Christian Right or Moral Majority. It was also said that Mc Cain called Jerry Falwell intolerant at one time. I agree with Mc Cain's assessment of Mr Falwell. I just want to ask Mc Cain one question- Who is being intolerant now?
