This is a question mainly geared towards the House Heads (Admins) and Cancer himself.
Now if a Detail Master of a Cove/House creates and art work that then become ether the crest of said Coven/House or a major art pice representing said Coven/House. If they leave do they have the right to demand the art work be taken down and no longer used. do they still have rights to the piece if they "donate" it to said Coven/House? Or do they infact give up all rights the the piece once they "donate" the piece to the Coven/House?
Only if they have hand written confirmation by yourself saying that they have rights to the image, if not then the copyright belongs to you and you can have it taken down.
Well in most cases unless there is something different in writing, once it is donated the person gives up all rights.
But thats not a legally binding contract.
When i won the society logo contest i had to send a hand written letter to cancer saying i gave up the rights. If there is no binding contract then the copyright still belongs to the owner and he can do with it what he wishes.
The thing is the laws on donation os that unless you have a contract or written agreement that says you keep rights to the work you revoke them apon the donation of said item.

we are talking about someone that took a position in a "company" all they do for that "company" belongs to that "company"...
and that includes unpaid as well as paid....
Well if you look at it this way a coven is a "non-profit organization" and well everything you do for them is concidered a donation.
It can even mean things done off of company time if it applies to the business of the company.

I think you are under the mistaken idea that he is the donater.
If I read it right he is asking from the side that recieved the donation actually.
No i did not... i did say that said person has hense left said Coven/House.
needless i am an admin with in my Coven and if i had this issue could easily just delete anything i gave.
I think if you leave you should take the image bu if you donate than its theres not your image anymore.

This is something that has always bothered me... laws or no laws- policy or no policy. It pretty much equates to a child wanting to gather their toys and go home, *neener neener*. You know, the toys they can never use.
If I made graphics and allowed people to use them specifically for a House or Coven- it can only be an honor they still use them after a dispute.
But then again- this is just what I would assume since I have never been in the situation.
your donating it to the house or coven what rights do you want it not like your gonna get royalties lol
I agree with imagesinwords. If one has created something specifically for use here and one leaves...it is sort of to me like using your sidewalk chalks and making a pretty picture at your friends house and wanting to take it with you when you go home.
People get weird about what they think is "theirs" for sure (it is sort of the capitilistic mentality of "how can I profit from my creation, I think...)
...but when one is honored by having one's art work displayed on the House or Coven, then one should feel proud if said House or Coven continues to use the piece after departure.
Didn't some artist sometime say something about art being a gift to the world?
If not, they should have...
I hope I read this right but if you asking if you offered a house/Coven a donation of a gift of something, it should be honour and very much appreciate to the House/Coven for which you are trying to help =)
My feeling, for what it's worth, is, if the Master of the House/Coven is honorable, he should let the artist take his work, if that's what the member desires.....whether they part on good terms or bad.
By the same token, if the artist is honorable, he should at least consider leaving his work with the House/Coven....unless he was given das boot, for what he cosiders no good reason. In which case, I would understand his wanting to have his artwork removed. I would also think the other members of the House/Coven would NOT want to keep it displayed, if they felt the need to kick the member out.
To me, to keep the work of someone who was unhappy and felt no choice but to leave, or was kicked out for whatever reason, seems a selfish and/or spiteful act on part of the Master (or whoever ultimately made that decision) of that House/Coven.
Just my oh-so-humble opinion. Let my scoldings begin....
If it's given for the intended purpose to be used as a crest/shield then the 'donater' should have no rights for reclaiming. The 'donater' must have been aware that this peice of art would be something the covens/house members would grow fond of and display proudly. I think it would be too much to ask for each and everyone to take down something that means a lot to them. (unless of course it was to be replaced with a new shield/crest) I say, you gave up all rights when you allowed it to be used as a crest/shield. This subject annoys me a little.. I firmly beleive if you give something you shouldn't take it back. This goes with pages any person may have created/designed for a house/coven. You do NOT have the right just to click your fingers and demand it back if things aren't going your way for what you have done for the coven/house won't be forgotten and shouldn't be expected to.

i agree with the same thing. now i belive i have gotten the answers i seek and also the issue has been resolved ... but i am stll intrigued to see other people opion on this topic as well ...
I feel once it is donated then they should leave it behind cause it still stands for something even if said person was booted or left.. grant it the option of it staying or leaving should be up to the said person yet why would a person take back something that they gave up to begin with...just an opinon..
Fundamentally, the topic and discussion of this thread is exactly why House and Coven Masters should, by and large, create their own stuff.
Granted, no everyone has Photoshop or can use the thing. I bought a book and learned. If I can do it, anyone can. :-)
I admit that I had some (a lot of!) help with the technicalities of the images and the software used creating them for my House, but I created the concept for them and did 90% of the work, myself. All of the images used for my House, save one, are my intellectual propery.

If you have given permission to keep it then thats it you have no claim, if you havent, then you are within your rights
